Is Hiring a Private Detective Legal in India? What a Detective Can Do for You
Quick answer
Yes. Hiring a private detective is legal in India, and there is currently no central law that licenses detectives. A detective may do only what any private person may lawfully do: observe in public places, check public records, make discreet enquiries and verify documents. A good agency explains in the first consultation what is possible for your case.
Many families and businesses want to hire a detective but worry whether it is legal, or whether they could get into trouble themselves. The short answer is that hiring an investigator is legal, but the methods matter. This guide explains what a private detective in India can do for you, whether detectives need a licence, and how to choose an agency you can trust.
Is there a licence or law for private detectives in India?
There is currently no central law that licenses or regulates private detectives in India. A Private Detective Agencies (Regulation) Bill was introduced in Parliament in 2007, but it was never passed (bill text on PRS India). In practice, detective agencies operate as ordinary registered businesses.
That does not mean anything goes. A detective has no police powers. Everything an investigator does must be something any private citizen could lawfully do, and the ordinary criminal and privacy laws apply to them in full.
What a private detective can legally do
- Observe a person in public places, such as a street, market or office entrance, without harassing them
- Check public and court records, company registrations and other information that is lawfully available
- Make discreet enquiries with neighbours, colleagues, landlords and local shopkeepers who choose to talk
- Verify documents, addresses, education and employment claims
- Photograph what can be openly seen from a public place, without intruding on private spaces
- Write a factual report of what was found and how
These are the methods behind lawful work such as pre-matrimonial verification, post-matrimonial investigation and corporate due diligence.
What a private detective is not
A private detective is not the police. An investigator cannot arrest anyone, search a home or office, or act as a government official, and must respect the privacy and criminal laws that apply to everyone. Privacy is a fundamental right under the Constitution of India, as the Supreme Court held in Justice K.S. Puttaswamy v. Union of India (2017), and the Bharatiya Nyaya Sanhita, 2023 covers offences such as stalking (Section 78) and criminal trespass (Section 329).
What is possible depends on the case. A good agency explains this honestly in the first consultation, so you know what to expect before any work starts.
Is a detective's report valid in court?
A detective's report is not automatically evidence. Courts decide what to admit and how much weight to give it. Material such as a witness who can testify, documents from public records or photographs taken in public places is the most useful. Digital material such as photos and videos must also meet the rules on electronic evidence. If your case may go to court, speak to your lawyer before the investigation starts so the work supports your case.
Choosing the right agency
Because there is no licensing system, it is up to you to check the agency: a real office, relevant experience, a written scope and quote, and a clear report. Our guide on how to choose a detective agency in Chennai lists seven checks and the questions to ask on the first call.
Common lawful uses of a private detective

- Due diligence on a business partner, distributor or company before a deal
